Paper Negligence, gross negligence, and malpractice are terms that healthcare professionals fear being involved in. We have healthcare laws and policies that guide each healthcare practice. In todayââ¬â¢s litigious society, we see healthcare lawsuits that are wrongfully filled, some that are not valid, and some unjustly settled cases. Yet there are some situations where a lawsuit should have definitely taken place and no one filed. There are people that live of monies collected from lawsuits, while there are people that are uneducated, and unaware of these options. This paper will discuss the differences between malpractice, gross negligence, and negligence, and then use this information to comment on how a reasonable nurse would have possibly prevented that mishap that took place in the story of the patient in the Neighborhood, Episode 7, Season 3 newspaper article. ââ¬Å"Negligence is a general term that denotes conduct lacking in due careâ⬠(Guido, 2010). According to an article by Cornock, four elements must be proven to establish negligence, which are duty of care, breach of duty, harm, and causation (2011). Duty of care meaning that the healthcare professional owed the person a certain standard of care that he or she did not meet. Breach of duty is when the healthcare professional failed to act in a way that was expected from his or her professional area of expertise. Harm refers to the need to prove that harm has been sustained as a result of the breach of duty. Causation is speaking of needing to show a causal link between n the breach of duty and the harm suffered by the patient (Cornock, 2011). Malpractice is sometimes referred to a ââ¬Å"professional negligenceâ⬠(Guido, 2010). Malpractice encompasses patients receiving improper care as well as a break in the standards of practice of that healthcare professional. In order to file a malpractice lawsuit, the defendant must be a professional, such as a nurse, doctor, lawyer, etc. Courts have continually defined malpractice as professional misconduct, unreasonable lack of sill, or infidelity in professional or judiciary dutiesâ⬠(Guido, 2010). Usually malpractice results in the harm of a client. Among healthcare professionals, malpractice is any bad, unskilled, or negligent treatment that injures the patient. A standard of conduct is taken into consideration when analyzing malpractice cases. According to Quick, standard of conduct is the degree of skill and learning ordinarily possessed and used by members of the profession (2006). A member, who has met these standards, cannot generally be found negligent. Negligence and malpractice may be similar in nature and could possibly overlap. What determines the difference is if the person committing the act is a professional. A caretaker with no license would be accused of negligence and a nurse would be accused of malpractice. The other difference is that most courts have decided that professionals should be upheld to providing a higher quality of care than a non-professional. Gross negligence is when a healthcare worker knows that their actions will cause direct harm to the patient, but they do it anyway (Quick, 2006). Gross negligence, as defined, is a much more complicated and alarming concept. Gross negligence is an act or omission ââ¬Å"which when viewed objectively from the standpoint of the actor at the time of its occurrence involves an extreme degree of risk, considering the probability and magnitude of the potential harm to others; and of which the actor has actual, subjective awareness of the risk involved, but nevertheless proceeds with conscious indifference to the rights, safety, or welfare of othersâ⬠(Quick, 2006). Some examples would be using restraints as a convenience rather than for the patientââ¬â¢s safety until the patient develops either physical or psychological problems or not changing dressings on a post op patient until the patient develops an infection. The newspaper article in The Neighborhood, Episode 7, Season 3 is about a patient whom I believe was a victim of malpractice. He went into the local hospital to have one of his legs amputated due to diabetic complications. When he woke up from the surgery he discovered the wrong leg was amputated. He became terrified when he finally convinced himself that he would end up with no legs instead of what the original plan was. His quality of life would be tremendously affected. What he could do still having one leg; he would never again be able to do without any legs. The surgeon and the surgical team who committed this wrong are professionals and therefore this represents malpractice. The surgeon and his surgical team did not follow proper protocol prior to the surgery. As a nurse in this case I would have taken a few know precautions to lessen the probability of this type of life threatening mistake to occur. First, a pre-procedure checklist should have been prepared and signed off by multiple services such as surgical admitting, pre-op nursing staff, and finally operating room nurses prior to the surgery. These types of checklists have been adopted at most hospitals. The checklist includes verifying it is the right person, the right procedure, the right body part, the correct medications, and equipment. Performing a surgical pause or time and having all members agree would have eradicated this issue. If this checklist had been properly followed the mistake would have been prevented. Documenting everything that is done is a vital part of the nurseââ¬â¢s job, and one of the ways nurses can protect themselves from lawsuits. If a surgical pause had been done, and documentation had begun from the moment the patient arrived at surgical admitting that day, then mistakes like these would not have occurred. Documentation can greatly lessen the chances of untoward events like these. Conclussion With all the tasks at hand, it is easy to bypass documentation, and try to save some time by doing it later. In this example trying to save time has cost somebody to live the remainder of their lives with no legs. The article mentions a shortage of nursing staff that the hospital was experiencing. This most likely had a big impact on what happened in the operating room. The hospital will now probably face the challenge of keeping its doors open due to not dealing with employee concerns. Negligence, malpractice, and gross negligence can all be avoided simply by following hospital policies nd protocols.

An Analysis Of Education History Education Essay Introduction The analysis of education history in any system involves many concepts such as renaissance, reformation and Counter Reformation. Such concepts significantly affect educational with regard to systems, content, teachers and curriculum amongst many other aspects. In Kenya, the British colonialists introduced the first system of education. The formation of Ominde commission after independence saw the introduction of many changes in the educational system (Bogonko, 1992). At that time, issues of unity and identity were very critical and the authority largely focused on them. Following this, subject content changes were made in fields of geography and history to reflect aspects of national cohesion. A common curriculum for all schools was adopted between 1964 and 1985 involving a 7-4-2-3 system. This system involved seven years for primary education, four years for lower secondary, two years for upper secondary and three years for university education. In 1981, there were eff orts to reform the entire educations system through the Presidential working party commission. The committee tabled recommendations on changing the educational system from the 7-4-2-3 to the structure of 8-4-4 (Sifuna & Otiende, 2006). In 1985, the new system was launched that put more emphasis on subjects considered as vocational. The new structure would theoretically enable school leavers at varied levels to be self-employed or acquire informal sector employment. According to Sifuna & Otiende (2006), a detailed development of educational theory through the ages is presented. With vested interest in African education context, this book highlights the plight of education in Kenya through the ages to the 8-4-4 system. The credibility of this text is guaranteed by its diversity in approach with reference to African Islamic education. It is inevitable that African education has its roots in the western world hence Sifuna & Otiende included the history of western education in this book. Educational significance of concepts Renaissance concept. This concept involves the activity of educational and cultural reform spearheaded by writers, scholars and civic leaders. Such pioneers in the history of education are as of today referred to as humanists. The fourteenth and fifteenth centuries saw the development of this concept because of the challenges brought forth by the mediaeval scholastic education. This activity emphasized on scientific, practical and pre-professional studies as a response to the inherent challenges. Under the scholasticism, men were prepared to become lawyers, doctors and professional theologians through approved textbooks (Court & Kinyanjui, 1980). On the other hand, to change from training professionals in strict practice and jargon, the humanists emphasized on a citizenry creation hence enabling people to write and speak with clarity and eloquence. In addition, these professionals were capable of better engaging their communitiesââ¬â¢ civic l ife and hence persuading people to prudent and virtuous actions. The renaissance concept in education which is also known as the learning re-birth started in the 14th century in Europe and reached its peak in the 15th century. Humanist educators designed and formulated teaching methods for the education system that would prepare liberal and well-rounded persons. The educational renaissance in England saw the improvement of womenââ¬â¢s educational opportunities especially for those women from upper classes. The renaissance concept in Kenyaââ¬â¢s educational system can be explained through the analysis of the history of education. Prior to the gaining of independence in Kenya, there were three divisions in the education system with schools for Asians, whites and Africans. In such a system, there was segregation in that, whites attended the best schools, the middle class schools were reserved for Asians especially Indians and Africans attended the lower class schools (Sifuna & Ot iende, 2006).

These movements, despite their belonging to different spheres of art, literature and music, came to be known under a common name of modernism. It is not easily realised and admitted that modernism, for all its innovative spirit and love of experimentation, was fully consequential, if not predictable. It did not come out of nothing; it grew out of a certain tradition and emerged within the paradigm of rationalist and humanist values. An adequate first example to support our argument is T.S. Eliot, a poet who was also one of the first theorists of high modernism. On October 24th, 1929, the stock market fell 9% during the day, which was a huge deal back in that time when a lot of people had money invested in the Stock Market. After this decline there was a selling alarm, as everyone wanted to get his or her money out of the stock market. Bierman concludes that the stock prices were too high in October of ââ¬â¢29 and that a crash in the market was bound to happen. ââ¬Å"The Reasons Stocks Crashed in 1929â⬠by Harold Bierman Jr. reviews a small set of possible causes for the crash and reaches specific conclusions about the events that led to the biggest stock market crash in history. à à à à à The 29th of October will always be known as Black Tuesday but it was not the only day the stock market struggled. On October 23rd the market declined by four billion dollars and if the events of the 29th did not happen then the 23rd would have gone done in history as the major stock market event. The events of the 23rd were dwarfed by the proceedings of the morning of the 29th when it was said that within a few hours of the stock market being open that day, the prices had fallen so low that they wiped out all of the gains that have been made in the entire previous year. à à à à à Since the stock market was viewed as an indicator of the American economy, the publicââ¬â¢s confidence in the economy was shattered.

Long or Short Vacation

No one can deny that a vacation has many benefits for students. In Viet Nam, it has long been a controversy whether give a vacation should be long or short. Most of students think that is great if they have several short vacations each year while others disagree. Both opinions have their own advantages and disadvantages.From my point of view, it is better to have several shorts vacations throughout the years. The reasons are as follows. In my personal experience, almost people like vacations especially students. Short vacations can help students decrease pressures or depressions from their overloaded study, hard examinations and parentsââ¬â¢ desires had better than a long vacation. Speaking of study pressures, students always live in a tense state in which they have to cope with a plenty of continuous problems; a series of required knowledge they must study and a chain of examination they must take are ruining childrenââ¬â¢s pure mind day by day.To deal with this, one short vacation will be capable of giving a hand to the children who are in need of help to decreases these stresses. The students will have enough time to adapt to occurrence and balance their daily life, their academic study after sorrows. If thereââ¬â¢s only one long vacation per year, the students will only have one chance to face one stress while continuous matters happen steadily during the terms. In addition, students can regain energy easier and better by several shorts vacations. Shorter vacations are more rejuvenating.During the year, I am able to take several short trips to smaller towns, beaches, mountains in the surrounding area of where I live and I feel so much more refreshed when returning to study after one of these short vacations. Similarly, with short vacations I am able to sometimes go by myself or take friends, so there is always a sense of variety with each trip. By contrast, one long vacation can be tiring and at times quite boring. Indeed, after a long vacation, it is so difficult to restart my studying with highest efforts. In almost cases, it takes long time to adapt to study environment.Finally, short vacations make both students and their parents arrange plans for entertain or travel easier than one long vacation. The parents can send their children to short-term holiday camps or just have them travel. Likewise, the students in university can take short tours to domestic vacation spots. Such travels cost less money and are more available than long tours. Take my relationship for an example. Last summer holiday, my uncle sent my cousins to my grandmother because he did not have time to care of them in approximated 2 mo nths. On the other hand, for one-month vacation, my aunt sent her son to ââ¬Å"Army-term summer tripâ⬠.He said to me that the trip is the wonderful experience. The issue whether students should be given one long vacation each year or they should have several vacations throughout the year is the one that is open for debate. Although a long vacation has also some advantages, I think short vacation is better in many ways.
